Buyer guide

The option period:
your right to walk.

Texas gives buyers something many states do not: a short window, bought for a fee, when you can terminate the contract for any reason at all and get your earnest money back. Used well, it is the most valuable clause in the contract. Wasted, it is the most expensive mistake a buyer makes.

How it works

You negotiate two numbers in the contract: the option fee you pay the seller, and the number of days the option lasts. During that window you can terminate for any reason, or no reason. The fee is generally not refundable, though it is often credited toward your purchase at closing if you go through with it.

Deadlines run on calendar days and the clock is strict. Terminating one day late is the same as not terminating.

What has to happen in that window

Short option periods look attractive to sellers in a competitive offer. Just make sure you can actually get an inspector out in that time — in a busy stretch, booking one takes several days by itself.

Longer is not always better

A longer option period gives you room, but sellers read it as a weaker offer because their house is off the market with less certainty. A tighter window with a slightly higher fee often reads as more serious, and it costs you little if your inspector is already lined up.

What it is not

The option period is not a free look while you keep shopping. It is also not a price renegotiation tool to use for leverage with no cause — sellers talk, and agents remember. Use it for what it is: the window to learn what you actually bought before you are committed.
